Introduction
• The purpose of this questionnaire is to obtain the information that a lawyer requires in order to prepare a Will for you.
• Truvera Trust Corporation (“Truvera”) will keep your response to this questionnaire confidential and will disclose the completed questionnaire only to the law firm you designate to prepare your Will, or to other parties that you designate.
• The completed questionnaire will be reviewed by Truvera.
• In most cases Truvera will then send the completed questionnaire to the law firm you have designated to prepare your Will.
• The law firm will contact you shortly after it receives the completed questionnaire.
• In some cases, Truvera may contact you before sending the completed questionnaire to the law firm, for example if supplemental information is required.

Usage Tips
•
If you and your spouse each require a Will, then each of you should independently complete separate copies of this questionnaire.
• You will notice there are questions that require a “yes” or a “no” answer, if you do not check the “yes” box it is assumed that the answer is “no.”

Specific Bequests/Legacies

A) Any specific bequests or legacies to be included in your Will. For example, you may choose to leave specific property items and/or money bequests to certain persons or charities.
B) What is to happen if the recipient of a bequest or legacy predeceases you.
C) How the Residue of your estate is to be handled. The Residue is everything that remains after all of your specific bequests or legacies have been satisfied.
If you are a beneficiary of an estate or trust, or an executor or trustee of a Will or trust, you may be required to make provisions in your Will regarding your estate or trust benefit, or your executor or trustee position. You will want to have the appropriate documents available for your review with your lawyer, in case any such provisions need to be included in your Will.

Testamentary Trusts

for information about setting up trusts for any of your beneficiaries (i.e. your spouse, children or grandchildren) for purposes such as income splitting, asset preservation, income tax reduction, creditor protection, protection from spousal claims, timing of distributions, etc. Your lawyer will explain Testamentary Trusts in more details.
Enduring Power of Attorney
You may wish to appoint an “attorney” to manage your financial and legal affairs in case you become incompetent or incapable of managing your affairs before you die. This can be done through the use of an Enduring Power of Attorney. Truvera Trust Corporation,

has the expertise to act as your attorney, and would be pleased to be considered for this role, either alone or with one or more others. Your lawyer will explain Enduring Powers of Attorney in more detail.
An Enduring Power of Attorney is often prepared together with a Will. However, the cost of preparing a Will does not normally include the cost of preparing an Enduring Power of Attorney. Your lawyer will explain the costs.
Representation Agreement
You may wish to appoint someone as your representative to make decisions on your behalf regarding your personal and health care during any disability, illness or at end of life; should you become incompetent or incapable of managing your affairs. This can be through the use of a Representation Agreement. Your lawyer will explain Representation Agreements in more detail.
A Representation Agreement is often prepared together with a Will. However, the cost of preparing a Will does not normally include the cost of preparing a Representation Agreement. Your lawyer will explain the costs.
British Columbia law does not permit a trust company to act as a representative under a Representation Agreement having provisions which include health care or personal care. Accordingly, Truvera Trust Corporation,
